The man accused of murdering a Georgia nursing student appeared in court on Friday as his trial looms next month. Jose Ibarra, charged with the killing of 22-year-old Laken Hope Riley, a nursing student at Augusta University, faced pretrial motions, with his defense questioning the police’s actions during the investigation.

Riley’s body was discovered in February near running trails on the University of Georgia campus after she had been reported missing by a friend following a morning run. Ibarra, who pleaded not guilty to multiple charges, including murder, is accused of striking Riley in the head, asphyxiating her, and attempting to sexually assault her. His trial is set to begin with jury selection on November 13, followed by court proceedings the following week.

Ibarra’s illegal immigration status has drawn significant attention to the case. Having entered the U.S. illegally from Venezuela in 2022, his presence in the country during the time of the crime became a focal point of national immigration debates. Prominent Republicans, including former President Donald Trump, have cited Riley’s death as a consequence of President Joe Biden’s immigration policies, linking it to broader concerns about border security.

The indictment against Ibarra includes 10 charges, among them malice murder, felony murder, aggravated assault, and kidnapping. He is also charged with a peeping Tom offense, after allegedly peering into an apartment window on the same day as Riley’s murder.

During Friday’s hearing, defense attorneys requested that the trial be moved from Athens due to the publicity surrounding the case and also sought to separate the peeping Tom charge, which involves a different victim. They also challenged the validity of search warrants that led to the seizure of Ibarra’s cellphones, arguing that police entered Ibarra’s apartment without proper cause.

Police testimony revealed that officers initially entered the apartment to address a potential fire hazard when a stove had been left on. During this check, officers found Ibarra and others inside. After clearing the apartment, officers noted that Ibarra’s knuckles appeared bruised, raising suspicions.

Judge H. Patrick Haggard did not immediately rule on the defense’s motions but will continue to hear arguments as the trial date approaches.

At least there’s one candidate on the ballot this November calling for the death penalty for illegal aliens who murder American citizens.
